These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and ShieldNav, LLC ("ShieldNav," "we," "our," or "us") governing your access to and use of the ShieldNav mobile application and any related services, features, or content (collectively, the "Service").
By downloading, installing, or using ShieldNav you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Service.
These Terms apply to all versions of the ShieldNav app, including iOS and Android versions, and any web-based properties operated by ShieldNav.
ShieldNav is intended for users who are at least 13 years of age. If you are between 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we learn that a child under 13 has created an account, we will delete it promptly.
You may sign in to ShieldNav using email and password, Google Sign-In, or Apple Sign-In (collectively, "Authentication Services"). By creating an account you represent that:
You may maintain only one ShieldNav account at a time. Creating multiple accounts to circumvent restrictions, trials, or subscription requirements is prohibited and may result in termination of all associated accounts.
ShieldNav uses Firebase Authentication to manage sign-in. We do not store your raw passwords. You are solely responsible for all actions taken through your account. ShieldNav will not be liable for any loss arising from unauthorized use of your account that results from your failure to safeguard your credentials.
ShieldNav provides GPS-assisted, crime-aware navigation. Core capabilities available to all registered users include:
A paid subscription ("ShieldNav Premium") unlocks the following additional features:
Premium features are described in more detail within the app. We may add, modify, or remove Premium features over time with or without notice; however, we will not materially reduce the core value of the Premium subscription without reasonable advance notice.
We strive for high availability but do not guarantee that the Service will be uninterrupted, error-free, or available in all geographic areas. We may suspend or modify the Service at any time for maintenance, legal compliance, or other business reasons. We are not liable for any loss resulting from service interruptions.
If you purchase ShieldNav Premium through the Apple App Store, the following terms apply in addition to (and, where they conflict, supersede) the general billing terms below. This disclosure is required by Apple.

Current prices are always displayed at the point of purchase within the App Store listing. Prices are denominated in your local currency and may vary by region. ShieldNav reserves the right to change subscription prices; you will be notified of any price change in advance and your continued use after the effective date constitutes acceptance.
Subscriptions automatically renew at the end of each billing period (monthly or annual, as applicable) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current renewal price.
Payment is charged to your Apple ID account at the time of purchase confirmation. Subscriptions are managed and billed entirely by Apple through In-App Purchases. ShieldNav does not directly collect or store your payment information. RevenueCat is used solely to verify and manage entitlement status; your payment details are never accessible to ShieldNav.
ShieldNav may offer free trial periods for ShieldNav Premium from time to time. If a free trial is offered:
You may cancel your ShieldNav Premium subscription at any time. To cancel:
Cancellation takes effect at the end of the current billing period. You will continue to have access to Premium features until then. Cancellation does not entitle you to a refund of any already-charged fees.
ShieldNav does not issue refunds for partial subscription periods. All subscription purchases are final once charged. If you believe you are entitled to a refund, you must request it directly from Apple through the App Store. Apple's refund policies govern all purchases made through the App Store. To request a refund from Apple, visit reportaproblem.apple.com.
If you subscribed on iOS via Apple In-App Purchase, your subscription is linked to your Apple ID and must be managed through Apple. Deleting the ShieldNav app does not cancel your subscription. You must cancel through the Settings app as described in Section 4.5.
If Family Sharing is enabled for your Apple ID and ShieldNav participates in Family Sharing, the purchasing account holder's subscription may be shared with qualifying family members. We are not responsible for any unintended sharing of subscription access resulting from Family Sharing settings you configure.
You may use ShieldNav solely for lawful, personal, non-commercial navigation and safety-awareness purposes consistent with these Terms. Any other use requires our prior written consent.

The ShieldNav app, including its source code, design, user interface, graphics, text, logos, branding, and all related intellectual property, is owned by ShieldNav, LLC or its licensors and is protected by United States and international intellectual property laws. All rights not expressly granted herein are reserved.
Subject to your compliance with these Terms, ShieldNav grants you a limited, non-exclusive, non-transferable, revocable license to download and use the ShieldNav app on devices you personally own or control, solely for your personal, non-commercial use. This license does not include the right to sublicense, modify, sell, or distribute the app or any content derived from it.
Map data, routing, and certain location features are provided through the HERE Maps SDK under license from HERE Technologies. Crime data is sourced from public municipal databases. All third-party content remains the property of its respective owners and is subject to the applicable third-party terms. ShieldNav's license to you does not extend any rights in third-party content beyond what is strictly necessary to use the Service.
If you submit ideas, suggestions, bug reports, or feedback about the Service ("Feedback"), you grant ShieldNav a perpetual, irrevocable, royalty-free, worldwide license to use, copy, modify, and incorporate such Feedback into the Service or any other product without restriction or compensation to you.
"ShieldNav" and the ShieldNav shield logo are trademarks of ShieldNav, LLC. You may not use our trademarks without prior written permission. Other trademarks referenced in the app belong to their respective owners.
ShieldNav integrates the following third-party services to deliver its functionality:
Your use of third-party services embedded in or linked from ShieldNav is subject to the respective terms and privacy policies of those providers. ShieldNav is not responsible for the accuracy, availability, or practices of any third-party service. Links to third-party terms of relevance:
Reference to any third-party service within ShieldNav does not constitute an endorsement by ShieldNav of that service or its operators. We have no control over third-party content and make no representations or warranties regarding it.
The availability of certain ShieldNav features depends on the continued availability of third-party APIs and services. If a third-party service experiences an outage or terminates our access, features dependent on that service may be temporarily or permanently unavailable. ShieldNav is not liable for disruptions caused by third-party service failures.
Our collection, use, and disclosure of personal information, including location data, is governed by our Privacy Policy, available at shieldnav.com/privacy. By using ShieldNav you agree to our Privacy Policy, which is incorporated into these Terms by reference.
ShieldNav requires access to your device's GPS and location services to provide navigation. Your real-time location is used only during an active navigation session and is not stored persistently on our servers. Location data processed in-session may be used to calculate routes, display your position on the map, and determine relevant crime data for your area. We do not sell or share your location data with advertisers.
ShieldNav may send push notifications via Firebase Cloud Messaging, such as safety alerts, feature announcements, or account notifications. You may opt out of push notifications at any time through your device's notification settings. Opting out of non-essential notifications will not affect core navigation functionality.
User profile information (such as your display name, email, and preference settings) is stored in Firebase Firestore. This data is used to personalize your experience and to manage your subscription status. You may request deletion of your account and associated data by contacting us at support@shieldnav.com.
We do not knowingly collect personal information from children under 13. Users between 13 and 17 should use ShieldNav only with parental or guardian consent. If you believe a child under 13 has provided us with personal information, please contact us immediately and we will take steps to delete such information.
This section contains critical limitations on the nature and reliability of information provided by ShieldNav. Failure to understand these limitations could affect your safety.
ShieldNav is designed to assist with route planning and to provide general awareness of publicly reported crime patterns. It is not a real-time emergency alert system and is not a substitute for emergency services.
If you are in an emergency, call 911 immediately. Do not rely on ShieldNav to alert you to imminent danger. ShieldNav cannot detect or warn you of crimes as they are happening.
Crime data displayed in ShieldNav is sourced from publicly available municipal open-data portals and may be subject to significant limitations, including but not limited to:
Crime data in ShieldNav should be used as one of many inputs to inform general caution — it is not a guarantee of safety in any area and is not a guarantee of danger in any area.
ShieldNav does not guarantee, represent, or warrant that any route, area, or location is safe, unsafe, crime-free, or free from any particular risk. The absence of crime data for an area does not mean the area is safe. The presence of crime data for an area does not mean the area is currently dangerous.
You must not look at or interact with your phone screen while operating a moving vehicle. Mount your device securely and configure audio guidance before you begin driving. Keep your eyes on the road at all times. Distracted driving is illegal in most jurisdictions and can cause serious injury or death. ShieldNav is not responsible for any accident, injury, or legal consequence arising from distracted driving.
Turn-by-turn navigation instructions, speed limit data, and toll information are provided for reference only. They may not reflect current road conditions, temporary closures, construction, or recent changes to traffic laws. You must always obey all applicable traffic laws, signals, and posted signs regardless of what the app displays. ShieldNav is not liable for traffic violations, accidents, or loss arising from reliance on navigation data.
Crime data reflects reported incidents in specific geographic areas. It does not and must not be used to make assumptions about the character, safety, or criminality of any individual or group. Using ShieldNav's crime data to discriminate against individuals based on race, ethnicity, national origin, religion, gender, disability, or any other protected characteristic is strictly prohibited and a violation of these Terms.
This section limits ShieldNav's legal liability. Please read it carefully.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHIELDNAV, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS (COLLECTIVELY, "SHIELDNAV PARTIES") DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SHIELDNAV OR ITS REPRESENTATIVES CREATES A WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SHIELDNAV PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE SHIELDNAV PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO SHIELDNAV IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain categories of damages. In such jurisdictions, the limitations above apply to the maximum extent permitted by law, and nothing in this section shall limit or exclude our liability for fraud, gross negligence, or willful misconduct.
The limitations in this section reflect the allocation of risk between the parties and are a fundamental element of the basis of the bargain between ShieldNav and you. ShieldNav would not provide the Service without these limitations.
You agree to defend, indemnify, and hold harmless the ShieldNav Parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way related to:
ShieldNav reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses.
You may stop using ShieldNav at any time by deleting the app from your device and, if you have an account, by requesting account deletion at support@shieldnav.com. If you have an active paid subscription, account deletion does not cancel your subscription — you must cancel separately through the App Store as described in Section 4.5.
We may suspend or terminate your access to the Service at any time, with or without notice, if:
Upon termination, your license to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination — including Sections 6, 9, 10, 11, 12, 14, and 17 — will survive. If your account is terminated due to a violation of these Terms, you are not entitled to a refund of any unused subscription period.
ShieldNav reserves the right to discontinue the Service, or any feature of the Service, at any time. If we discontinue a paid feature of ShieldNav Premium, we will provide reasonable advance notice and, where technically feasible, a pro-rated credit or refund for any prepaid subscription period affected.
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before initiating any formal dispute proceeding, you agree to attempt to resolve any dispute informally by contacting us at support@shieldnav.com. We will attempt to resolve the dispute within thirty (30) days of receiving your notice. If we cannot resolve the dispute informally within that period, either party may initiate formal proceedings as described below.
Except for claims that qualify for small claims court and except as otherwise provided below, you and ShieldNav agree to resolve all disputes through binding individual arbitration rather than in court. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at adr.org. The arbitration will be conducted in English. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND SHIELDNAV EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All claims must be brought in your individual capacity. If a court finds this class action waiver unenforceable, the arbitration agreement in Section 14.3 shall be void as to that claim only, and that claim shall proceed in court.
Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court. Such claims must be filed in a court of competent jurisdiction in the State of Illinois.
You may opt out of the arbitration agreement by sending written notice to support@shieldnav.com with the subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts of the State of Illinois.
For any claim not subject to arbitration, you and ShieldNav consent to the exclusive jurisdiction of the state and federal courts located in the State of Illinois, and you waive any objection to the exercise of personal jurisdiction by such courts.
We may update these Terms from time to time. When we do, we will revise the "Last Revised" date at the top of this page. For material changes, we will provide you with at least thirty (30) days' advance notice through one or more of the following means:
Your continued use of ShieldNav after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and, if applicable, cancel your subscription before the changes take effect.

The following terms apply when you download ShieldNav from the Apple App Store. These terms supplement and, where applicable, supersede the general Terms above.
You and ShieldNav acknowledge that these Terms are concluded between you and ShieldNav, LLC only, and not with Apple, Inc. ("Apple"). Apple is not a party to these Terms and is not responsible for ShieldNav or its content.
The license granted to you for ShieldNav is limited to a non-transferable license to use ShieldNav on any Apple-branded products that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. These Terms may not provide for usage rules for ShieldNav that are in conflict with the Apple Media Services Terms and Conditions as of the date you download ShieldNav. You acknowledge that you had the opportunity to review the Apple Media Services Terms and Conditions.
ShieldNav, LLC is solely responsible for providing maintenance and support services with respect to ShieldNav, as specified in these Terms, or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to ShieldNav.
ShieldNav, LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms. In the event of any failure of ShieldNav to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for ShieldNav (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to ShieldNav, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be ShieldNav, LLC's sole responsibility.
ShieldNav, LLC, not Apple, is responsible for addressing any claims by you or any third party relating to ShieldNav or your possession and/or use of ShieldNav, including: (a) product liability claims; (b) any claim that ShieldNav fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that ShieldNav or your possession and use of ShieldNav infringes that third party's intellectual property rights, ShieldNav, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

ShieldNav, LLC and you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
These Terms, together with the Privacy Policy and any additional terms disclosed to you in connection with specific features or promotions, constitute the entire agreement between you and ShieldNav with respect to the Service and supersede all prior agreements, understandings, and representations.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
ShieldNav's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of these Terms must be in writing and signed by an authorized representative of ShieldNav to be effective.
You may not assign or transfer any of your rights or obligations under these Terms without ShieldNav's prior written consent. ShieldNav may assign these Terms or any rights hereunder without restriction and without notice to you. These Terms are binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.
ShieldNav shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, acts of war or terrorism, labor disputes, power outages, internet disruptions, actions of governmental authorities, or the unavailability of third-party services.
You agree to comply with all applicable export control laws and regulations. You represent that you are not located in a jurisdiction subject to U.S. trade sanctions and that you are not a prohibited party under applicable U.S. export control laws.
Nothing in these Terms creates, or shall be construed to create, a partnership, joint venture, employment, franchise, or agency relationship between you and ShieldNav. You do not have any authority to bind ShieldNav in any respect.
Section headings in these Terms are for convenience only and shall not affect the interpretation of any provision.
You agree that these Terms and any notices provided under them may be delivered electronically, including in-app notifications and emails. Electronic delivery satisfies any requirement that such documents be "in writing."
These Terms are written in English. Any translation provided is for convenience only. In the event of any inconsistency between the English version and any translation, the English version governs.
